If any of these resignate with you or apply to you, then you need to Protect your Wealth, it is deemed necessary to change the environment in which it is held and also in which it grows to inheritly pass to the next generation.
Therefore, moving that build up property portfolio or investment savings into a tax protected structure, will minimise the tax liability of your next generation, and crucially it will not form part of their estate.
The Assets in the structure will grow free of tax and will ultimately pass to the next generation free of IHT (Inheritance Tax).
For example, A property owned personally can be transferred into a robust trust structure and provided the donor survives 7 years his beneficiary(s) will inherit the assets in the trust completely free of IHT. Also, in the interim, that said property is fully protected from ongoing Creditors, Lawsuits, and matrimonial settlements. There is no limit to the amount of assets that can enter the trust structure, and as well as personal properties, other assets such as stocks and shares, cash, company owned properties and the family home can also enter the trust structure.
It is important to note that the assets in the trust are held in the name of the Trustee (Settlor) for the beneficiary(s) absolutely, who has the right to all the capital and income of the trust.
There is a requirement for the trust to be registered at HMRC for tax purposes as income tax is payable by the beneficiaries on any trust income.
Company owned property and other assets can also be placed into a separate trust structure and administered by a fiduciary company (Fidco). The shareholders of the original trading company, who will also be directors of Fidco, would exercise full control and management of Trust Assets.
Assets entering the Trust structure, which could include excess cash reserves sitting on the balance sheet, and subject to up to 40% tax liability, will be inherited by the beneficiaries free of IHT.
Also, excess Cash reserves could disqualify Business Property Relief (BPR) in in a trading company, as HMRC could deem it an Investment Company. Fidco will have full investment powers and can even lend cash back to the original trading company if deemed necessary.
Tax is only applied to the gains made through the investments, including investment income. Crucially however, the trading company will no longer be deemed an Investment Company, and BPR can be claimed on the company share value.
